Bloop360 is a product developed and provided by Tootelo Innovation (hereinafter referred to as “Tootelo”).
These Terms of use, as defined below, govern and define your use of the Bloop360 service (hereinafter “Bloop360” or the “Service”). By purchasing or using the Service, you agree to be bound by these Terms of use and acknowledge that you have read them (the “Terms of use”).
You acknowledge and agree that the Terms of use may be modified in accordance with the provisions set forth below, and you are therefore invited to consult the Terms of use on a regular basis.
1. AGREEMENT
By using Bloop360, you agree to the following:
● not to use the Service, or allow or facilitate its use by any person, in a manner that constitutes or encourages knowingly perpetrating a criminal or civil offense or infringement of intellectual property rights, or in a manner that violates any law or regulation;
● not to use the Service, or allow or facilitate its use by any person to publish any content that, in the opinion of a reasonable person, constitutes an invasion of a person's privacy, an invasion of a person's physical or moral integrity or constitutes defamatory, abusive, racist, violent, hateful or intimidating content, ethnic slurs or homophobic slurs or slurs against any religion or spiritual belief, as well as any attack on a particular person or group of persons;
● not to use the Service, or allow or facilitate its use by any person without reading and accepting the Terms of use;
● not to create or participate in the creation of a website or service that reproduces, in whole or in part, the services offered by Bloop360;
● not use the Service or allow or facilitate its use by any person to post content that a reasonable person would consider to be crude, obscene, indecent, vulgar, sexually suggestive or offensive to standards of public decency;
Finally, you acknowledge that you are solely responsible for ensuring that your systems are capable of using Bloop360.
2. ACCESS VIA MICROSOFT
Not only is Tootelo a Microsoft-certified solutions partner, but Bloop360 is also a Microsoft-certified software. This certification attests to the quality, performance, reliability and relevance of our software.
To acquire Bloop360, a designated administrator in your organisation must first grant Tootelo the permissions and access rights required to ensure that Bloop360 runs properly when deployed in your organisation. Since Bloop360 must be able to access emails, calendars and electronic exchanges between members of your organisation (without accessing their content) in order to target the interactions to be evaluated, it is necessary for you to grant these permissions. You can access our Privacy policy and section 4 below on protecting your data for more information.
Once access has been granted, the Bloop360 application will be installed in your company's Microsoft Entra suite, enabling us to access your employee directory and create an access (identification) for each person in Bloop360. Once the accesses have been created, each member of your organisation will be able to access Bloop360 from the www.bloop360.com website, and will receive a daily peer review or self-assessment request.
3. WARRANTY AND LIMITATION OF LIABILITY
Bloop360 is provided without warranty or condition as to its functionality. The Service may not be provided without interruption or error. These provisions do not limit any warranties or rights that may be provided under consumer protection laws and regulations.
Tootelo shall in no event be liable for any damages caused by the use of its Service or any other damages, direct or indirect, suffered in connection with the use of the Service, or the inability to use the Service for any reason beyond the control of Tooelo. More specifically, Tootelo declines all such liability, including in particular any liability relating to any delay in the performance of the Service.
4. DATA PROTECTION
Tootelo shall use the personal and other information you provide to us or to which you give us access only for the intended purpose for which we collected it. We shall retain your Personal information only for as long as is necessary to fulfill the purpose for which such information was collected and to the extent permitted or required by law.
We will not sell, trade or otherwise communicate your information and data to third parties, subject to exceptions provided by law or unless we have obtained your prior consent.
Tootelo implements a series of reasonable physical, administrative, technological and organisational security measures to adequately protect the confidentiality and security of your Personal information against loss, theft or any unauthorised access, disclosure, reproduction, communication, use, modification or destruction. These measures include encryption, a firewall, isolated databases for each customer, etc.
